These terms of sale apply to all aspects of business carried out by Steelfen Ltd Trading as Automaticgate.co.uk . Before engagement, you will be required to sign our latest version of terms and conditions. Steelfen reserves the right to modify or introduce any particular clause, in writing relevant to an individual element before the commencement of said work.
“Others” is deemed to be any third party other than Steelfen or its approved subcontractors.
1.0) All quotations are based upon works carried out during our regular office hours 8am-5pm and Saturdays 9 am to 5 pm unless otherwise stated. Work outside these hours is subject to a surcharge.
1.1) All estimates and recommendations made by Steelfen are based upon our representatives’ assessment of the customer’s needs. It is the customers’ responsibility to make sure that all his/her requirements are included in the quotation, and if there is any doubt, to contact Steelfen to clarify.
1.2) All estimates & quotations are subject to site survey and are valid for a period of 28 days unless otherwise agreed in writing.
1.3) Quotations only include the work specified, and any additional work or parts required will be charged as extra to the original quotation.
1.4) Extra items will be charged based on the current ruling ‘Service Call Out’ and hourly rates plus parts. The customer will be required to approve any such extras in writing in advance of fitment.
1.5) All offers made by Steelfen are based on estimated customer requirements given by the customer. It is the customer's responsibility to inform Steelfen if the anticipated use of the system is to change during the warranty period.
1.6) Steelfen reserves the right to use approved and trusted subcontractors for any part of the works if necessary.
1.7) It is the responsibility of the customer to inform Steelfen if the access/exit of the location of the system has any security or safety status, or is a fire escape or fire brigades access route.
2.0) The customer is to inform Steelfen if the system is to ‘Fail Secure’ during a System or Mains Power Failure.
2.1) No responsibility shall be taken by Steelfen for unseen circumstances or obstruction.
2.2) It is the responsibility of the customer to advise Steelfen of the whereabouts of any underground or hidden service routes such as gas, water or electricity. If an underground service is damaged, Steelfen will not be held responsible for the consequences and costs arising from damage or injury resulting, however, caused.
2.3) Any structural modifications recommended or carried out by Steelfen or any sub-contractor will be made subject to all said works being carried out under the direct authorisation of the customer.
2.4) If a structural engineer or other professional body be required in any way, all costs associated with this element of work are to be met directly by the customer.
2.5) It is essential that driveway gate leaves travel over level ground. Accordingly, Steelfen cannot accept liability for the consequential effects of ground level obstructions.
2.6) In the event of flooding Steelfen will not accept responsibility for any consequential damage or repairs necessary. It is, therefore, the responsibility for the customer to ensure adequate drainage and regular maintenance checks.
3.1) All our prices assume clear, unimpeded access to the area of works. Pedestrian and vehicular traffic must be reduced and avoided where possible during the works. Any delay caused to works that are beyond Steelfens direct control will be charged as extra over the agreed value, at IG standard engineering rate.
3.2) All quotes assume on-site parking for Steelfen vehicles local to the work location and as such would become eligible for additional charge should this not be available. The customer will be responsible for any parking fines as a result of parking being unavailable.
4.1) The provision of a suitable power and water supply to the working area is the responsibility of the customer.
5.1) In all cases building works (civil works) - concreting, driveways, brickwork and final decoration is to be done by others.
5.2) Any building works agreed to be done by Steelfen in writing, will be left in a state similar to that which previously existed - further decoration is to be done by others at customers own cost.
5.3) Steelfen does not accept liability for any consequential effect or damage to foliage or vegetation.
6.1) Where existing supporting structures such as brick piers, timber or metal posts are assessed to not be unsuitable, the client will be advised before further work is undertaken. Any assessment made by our surveyor, concerning the suitability of said structures or support is made in good faith, and no responsibility will be accepted for their continued stability over time. We would be pleased to provide a quotation for the additional cost of replacing any support structure, at any time, if so required.
7.1) Under no circumstances will Steelfen accept responsibility for any inherent problems resulting from hardwood or softwood timber products.
8.1) All 220/240V cable runs (mains supply, controls supply) installed by us will either be surface mounted S.W.A. or PVC flexible conduit protected cables, unless specified otherwise. (British Standards will be implemented).
8.2) Earth Leakage Circuit Protection (RCD) is always recommended for each mains supply run.
8.3) All low voltage cable runs (24V+/- ) carried out by Steelfen, are to be installed according to each site’s condition and are to be surface fixed or follow routes provided by others. Direct burial 12 core RBS multi-core cable is advised and will be used where practical for data requirements.
8.4) Steelfen will endeavour to abide by all official guidelines and laws relevant to works and service provided for by IG only and not works carried out by others. All such IG responsibilities are passed over to the customer upon official completion of any said works or part thereof.
9.1) All cable routes, trenching, ducting or trunking installed by Steelfen are done so under the discretion of Steelfen engineers and will follow a path most suited to the systems requirements. If a preferred route for any cable run is required by the customer, it is the customer’s responsibility to agree with Steelfen before work begins.
9.2) All ducting runs carried out by others, for Steelfen use, must be carried out to our specifications. No responsibility will be taken by Steelfen for cable runs provided by others - even if the cable is supplied by IG. It is the customer’s responsibility to ensure a fault-free cable run.
10.1) It is the customer’s responsibility to inform Steelfen if there is any planned change to the landscape of the entrance, as this may affect the performance of the system. IG must be notified of any changes to the landscape as soon as possible.
12.1) Any connection or modification to an Steelfen gate system, in any way, by others will void any warranty unless specifically agreed in writing beforehand by IG.
12.2) All existing items used or re-used, will remain the responsibility of the customer. Any inspection, test or comments made by Steelfen are given in good faith without warranty of any kind.
12.3) All repairs carried out by Steelfen, are carried out with the overall interest and safety of the customer and other users.
12.4) Repairs that are likely to exceed a value of £500 will require pre-authorisation in writing and/or a deposit before the works are carried out.
13.1) Steelfen accepts no responsibility for consequential loss caused by faulty goods or installation. Steelfen’s liability is limited solely to the repair and replacement of the defective goods, or installation of such.
15.1) ALL GOODS REMAIN THE PROPERTY OF INSTAGATE LTD UNTIL PAID FOR IN FULL. ONLY ONCE PAYMENT ON ANY GOODS OR SERVICES IS RECEIVED BY IG THE TITLE TO SAID GOODS OR WORKS WILL BECOME THAT OF THE CUSTOMER. ALL CONTROL EQUIPMENT WILL NOT BE RELEASED UNTIL A FULL HANDOVER HAS BEEN CARRIED OUT AND PAYMENT RECEIVED.
15.2) During the installation, all parts installed or left on site become the responsibility of the customer. The customer is therefore advised to check insurance cover.
16.1) Supply and install: Terms of Payment: 50% Deposit with the order. Balance in full upon completion.
16.2) N.B. THE FULL AMOUNT OF MONEY IS DUE UPON COMPLETION, EVEN IF COMMISSIONING IS HELD UP BY CIRCUMSTANCES BEYOND OUR CONTROL.
16.3) If an additional site visit is necessary to commission work, an extra charge will be made at our current service rate.
16.4) Supply Only: Terms of Payment: Full payment with order unless the account is opened by IG Management. Account Customers: 30 days credit up to approved limit only.
16.5) Service & Repair Works: Terms of Payment: Payment is due on completion of any part of works invoiced.
16.6) Maintenance Agreement: Terms of Payment: Annually in advance or monthly via direct debit.
16.7) Steelfen reserves the right to add interest to any outstanding debt not settled within 28 days of the date of invoice, at an annual rate of 8% on the debt outstanding.
16.8) Steelfen reserves the right to stop or put on hold any works or supplies due to financial disputes of any kind.
16.9) Steelfen reserves the right to refuse any customer or account to any party without explanation.
17.0) All orders placed and subsequently cancelled by the customer must be done so in writing to InstaGate™ Ltd, The Long Lodge, 265-269 Kingston Rd, London SW19 3NW
17.1) All orders placed on custom-made products and cancelled by a customer mid production will incur a cancellation charge of no less than 50% of the initially agreed sum.
18.1) Should there be a site delay preventing installation commencement, IG reserves the right to invoice for 90% of the estimated contract amount.
18.2) In the event of an extended delay, i.e. 30 days plus, not of Steelfen’s making, Steelfen reserves the right to levy storage of 5% per month of the sale only value of the said goods.
19.1) Steelfen reserves the right to be permitted an extension of time for the completion of any installation should adverse weather, or other condition beyond the direct control of IG, prevent access to the site or delay Steelfen’s carrying out the work.
20.1) All parts purchased by IG of any kind, manufactured by others, will carry the warranty of the said manufacturer.
22.1) Warranty Periods: New Products or installations carry a 24-month warranty from IG, subject to normal wear and tear.
Two years manufacture's warranty (return to base) on all gate operators.
Two years manufacture's warranty on Access Control Equipment.
23.1) Steelfen may use photographs of installations for marketing purposes unless requested not to do so by the client in writing.
24.1) This contract shall be construed and operated under the laws of England and proceedings shall be brought in the English Courts.
